    I have read on this forum and an immigration lawyer also confirmed to me that knowing the I40 receipt number itself is enough. She said that I can print out the case status of I140 approval from USCIS website and use it. Though I did not take the job offer for which I needed this information so I have not used it.

    FOIA should not take 8 months.. I applied for it at end of Jun and my number was around 3900 and it is now around 800 so I expect to get it in next 1 month so FOIA should give you copy of I140 in approximately 3-4 months.

    Is there any legal issues?

    Is it a good idea?
    It's a BAD idea. It has been discussed for several 100 pages, and thrown out of the window by the experts and core group.

    Remember couple of things:
    1. Suicide attempt is illegal in the USA
    2. Satyagrah is to correct any injustcie. If there are too many people applying for GC than the available number of visas then long wait is inevitable, that's not injustice.
    3. Satyagrah/hunger strike is a last resort meaning only when you run out of all other option such as Legal Battle, contacting Govt/politicians etc. Did you file a law suit yet about revised July visa bulletin?

    She could join from the day when the papers for transfer was mailed, this is as per AC21 law. She does not need to wait to receive the receipt from USCIS.

    yea its not a premium processing case. we r just trying to play it safe by waiting for the receipt. the new employer is not giving her grief or anything about joining quickly. the paralegal said that they are experiencing delays at uscis. i guess this whole bi-specialization thing is gona end up being another orginizational fiasco.

    Hello

    I am on currently H1B visa using AC21 portability based on I140 approval from previous employer. This is my 9 th year and H1B is expiring April 2010. My current employer is starting H1b renewal again. I do not have H1B visa stamp in my passport as I did not travel outside the USA for last 5 years.

    Through my wife's I 485 filling I am beneficiary on that petition. I have applied for advanced parole for both of us to travel out of USA somewhere around March 2010.

    My questions are follow:

    1. Upon travel when I try to come back should I use this advanced parol or get a H1 visa stamp on my passport and make a entry based on H1 Visa?
    2. If I use advanced parol to make an entry does it invalidate my H1 status? I heard somewhere that If I use advance parol to make an entry than I can no longer be on H1 visa. In my case advanced parol I am getting is based on I 485 benefits from wife's I485 case.
    3. If making an entry on advance parol does not affect my H1 status, then should I still go to US embassy and get H1 visa stamp? Or it is no longer needed? Is it advisable not to have H1b stamp in my passport at all because I can use Advance Parol for internation travelling? The reason I am asking is because to get stamp in passport will require me to travel to embassy and consume my time from very limited time I am travelling.
    4. What are the documents I need to carry while I travel if advance parol is advisable to be used at port of entry?
    5. What are advantage/disadvantage of Advance Parol Vs H1b Visa for making an entry?
    6. and Lastly, the things I need to keep in mind while at port of entry?

    I know, I am asking too many questions. But to be honest, I am really nervous about this traveling as I have not travelled outside the US for last five years. And you know during these years many things must have been changed.

    I really appreciate any advise.

    I'll throw in my very non-expert opinion here, having shot just a few weddings basically in your position.
    The dress in the first shot is blown out. I might have angled the vertical dimension a bit lower to capture the full length portraits and avoid so much "dead space" at the top.
    The composition on the second one is ok, but the eyes are rolling all over the room (bad grammar intentional). Since I've never shot in a paid position where I had the authority to exclude other photography during the group shots (not that I would even then), I generally defer first to the "guest" photographers, telling everyone to take their turn one at a time, and to speak up before the photo to get the subjects looking at them. Then I take over the attention and get everyone to look at me for however many shots I need to take of that pose. BTW, it's always good to take a few shots of each pose, because you're almost guaranteed to have closed eyes in different shots. I'm sure the pros will be in shortly to fill us both in on a better way to do this (I'd appreciate that, too). :)
    The fill flash was done excellently, but the background is very contrasty and thus distracting.
    This is just MHO, and probably doesn't amount to much. Also, please don't feel bad - I've made most of these mistakes myself (and managed to pull off some others that you didn't think of). :o ;)

    Today, I received an email from USCIS that my EAD application got approved. My receipt date is on the 3rd week of May of 2007. What I don't understand is that the current processing time at NSC for I-765(EAD) for pending I-485 is March 26th, 2007.....

    Hello folks

    My fiances parents are applying for a B1/B2 Tourist visa on the basis of her 2 graduation ceremonies. We will get married in a court before her parents apply for a visa but the marriage ceremony will be between 2 graduations in US. If we also show that her parents are attending daughters wedding ceremony in US will the likelihood of them getting a visa increase? We can send a copy of marriage certificate before parents visa interview.

    I don't think so. The VO is interested in ensuring that your in-laws are visiting US for tourism / family visit and will return back after the visit. VO also wants to ensure that someone will pay for the entire trip and they will not become public burden.

    My mother had a sister living legally in the United States, and my parents planned to have her sponsor us for residency. Soon after landing in New York, my parents saw a lawyer. But we were told the process would take four or five years.

    Coming to the States was traumatic. In Ecuador, we had lived in a house. Here, we were in a small apartment. We didn�t know any English. But you know, at that age, things change quickly.     Hi All..

    I am on H1 since Oct 07. I haven't left USA so far and so I haven't gone for stamping. However, I heard that I need to go to stamping before completion of 1yr after getting H1. Is this true? and to what cases does this rule apply?

    Please help. I am confused.

    You can stay as long as you have the 797 with you, but if you leave teh country u can come back only with stamping....

    Hello,

    My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.

    Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.

    OK. Assume that you decided to take the "better offer" by throwing the previous "better offer" and they trasnfer your H1, before joining them you will surely get another "better offer" in few months, because you are always searching for that, what will you do?

    "Career growth is important and you have to catch the opportunities on your way." - I guess you misunderstood this.

    I will not encourage this practice at all.

    yes, 485 processing and 140 processing is different. They are joined thread, So they will not approve 485 until your 140 is approved.

    Thanks Marphad. BTW, do you have any idea what could they possibly ask for 485. I provided everything they've asked for when I first filed the case. If not, I guess I'll find out in a few days.....
