This is a good point. This leaves a grey area, isn't it? I give you green for this El_Guapo.

This is comedy. This El_Guapo wants to give green to his own post. Oh man, what an idea to get greens. :D

The July 2008 Visa Bulletin has said Exactly the same, but in different words, what I have been saying for the past few months about the EB2-India and EB3-India Movements.

EB2 India will move very fast till 01 JAN 06 as because based on June 2007 bulletin, just before the july fiasco,( http://travel.state.gov/visa/frvi/bulletin/bulletin_3236.html ) the PD for China is 01 JAN 06. That means in EB2 Category except India and China every other country is current. So till India reaches 01 JAN 06 PD in EB2, all the spill overs will be moved to EB2 India, because the spill overs will be alloted based on the priority of old PD(Priority Date). By the time India EB2 reaches 01 JAN 06, China PD in EB2 will move further from 01 JAN 06 by using its 7% quota. So Inidia PD for EB2 again moves fast till that changed China PD using the spill overs. After that India and China will share the spill overs based on the PD priority. All this happens if and only if the USCIS works effectively and uses all the available visa numbers for the present fiscal year. My prediction for EB2 India PD is it touch 2005 /even cross few months in 2005 by the end of this year if USCIS works effectively.

For all Eb3s along with EB2s with PD after April 2005, the movement in the coming visa bulletins wont be much encoraging unless the new Obama government does something significant about employent based category or immigrationvoice does a fruitful lobbying. The doings of something by obama government to employment based category is not in our hands. The only thing we could do is to help IV and help ourrselves by contributing to it to reach its financial target for better lobbying. Or else wait for the Visa Bulletin every month with great hopes, sorry dreams, for your PD to become current, and satisfy with your EADs for years ahead.

Please find the earlier post about Eb2 India and EB3 India movement on Jun 10th 2008 and the comments of our members.

    Hello everyone,

Those of you who had gone thru this process may be able to help me. My 7 year old daughter is a US citizen. If my family applies for Canadian PR, do I have to apply for PR for her also?. I have heard that US citizens do not need any permission to live in Canada. Any insight is appreciated.

    Thanks
    alexander

You really think so?? The next PMs name is not even on your poll lists!!
India and Russia have set examples to the rest of the world. How? well...
Russia- by showing how communism can be at its worst
India- by happily showing how democracy can be at its... you guessed it, "worst"
Dont agree?? True Democracy, implies "for the people and by the people", right?
well in India its a tiny bit different...."For the thugs and by the thugs" Now the word thugs vary in meaning depending upon the citizen affected... for some it might simply mean "currupt" for others "looters", for some others "dishonest" and for a unfortunate majority it goes to the extent of "murderers".
Now.....still interested in wasting time with the projections for Indian PM??

Couldn't be better....nothing is going to change. World would be a better place without these thugs. Waste of time.
In my point the alliance in India - political porstitutes.
Third Front - alliance of junkies...

i cant believe ppl think this is a brilliant idea..
economy is screwed for a while..citizens are on life support..and you want immigrants to be welcomed with open arms..
did i wake up in a fools paradise...

You are right, in times like these immigrants should not be welcomed with open arms so its time for you to pack-up and leave. Visit this website when you reach home and let us know you reached safely... safe travels.

Are you sure you understood it fully?

I wrote " if you think ", meaning a lot of harping on is happening based on the assumption that removal of country limits will impact ROW badly. It's not the fact. Though it has been explained a number of times that its not the case, some members obstinately stick to their guns and regurgitate it again!

Taking some sentence written by me out-of-context does not prove anything.

    Easy now!!! Simmer down.....

Its just that every time the VB comes out, we get a lot of posts from folks from India/China who want to remove country limits. And they talk about only removing the country limits, as if removing country limits is going to solve the problem.
You scare away ROW when you do that.

Can I ask you a question? How much of IV goals you have supported till date? How many IV activities you have participated? How much you have contributed? I'm interested in knowing. If you haven't , whether you have incentive or not, it doesn't make even a teeny difference to the movement.

In December 2006, I started my state chapter, and went around and held meetings and told folks about IV. Then in the summer of 2007, I, along with other folks, some from India and some from Europe, went around and met with the staff of three congressmen/women, and two senators. And then we urged another person to go and meet his congresswoman. We covered half the state delegation in the House, and both senators.

Is this some thing needs to pass or in proposal or already effected since the date they published on the website?

I have not ready the doc.

This is neither a proposal nor a bill that needs to go through the process. Its a memo to the USCIS service centers providing clarity on whats an employer-employee relationship means for a H1 petition to be considered for approval. The memo claims there was no clarity on what constitutes a fair employer-employee relationship and provides guidance to the USCIS service centers to follow the memo in processing all H1 applications. So technically, I would assume it is effective on the date it was released.

Yes it does not say interim memo....the underlying point was that the directive comes from DOS once all these numbers are used up by approved applications and not "filed applications"

The mid month retrogression can happen...not based on number of filed applications but based on number of approved applications....and if they have enough applications (preadjudicated) sitting for numbers to become available...the system should process all of them in one day...and you know what will happen then............

    http://www.imminfo.com/resources/cis-sop-aos/1-16.html

According to this manual..visa availability is determined by Visa bulletin ALONE..no where it mentions to look for an interin memo from INS..

I am developing a general framework in which you can plug in your own traumatic experience. The following is a good start. Please develop your own writeups.

From then on it was a scramble to fulfill a long list of requirements to be able to apply on time. The first task was for my husband to convince his HR to sponsor the process. Since they had already budgeted for the fiscal year and are on a spending freeze , it took a lot of convincing . The HR complied and gratefully we set out to get our Medical exams (at own cost of 150*2).Since we live in a small state with few doctors we drove 2 hours to a neighboring state to get them on time.

Being a mother of 3 small kids, I could not work on important paper works with them around. So after putting them to bed we spent the entire night pulling out the required documents from archives and placing them in order; numerous phone calls to parents back in India to collect their date of birth, place of birth information and completed the questionnaire.

Got passport pictures(60$) and mailed it all to our lawyers praying it will be one of the first to reach the department office on start of business on July 2nd.

The following are very good points that need more polish! The main point here is that we really can not understand this CRAP wih all other things in life which Americans are not facing!

We are raising families here, our everyday life is no different from any other AMERICAN middle class family with same expectations and hopes, so its not easy to presume that we can pull out or get out of this situation and return to our home countries.

Patience is not just a virtue but a way of life for thousands of Legal immigrants who have been living in the US for a number of years . Besides the everyday stress of Job,Mortgage,Health and education of their children they live with the added suspense of when their application for permanent residency ,commonly referred as "Green card" will move ahead from its deep slumber.

Then please pack your bags and leave the country in the next flight..

Good Answer, it is easier said then done. Anyone who has been working here without any issues at work place why should he/she leave because of delay in getting GC. Yes we definitely have an uncertain future but that should not stop people like us for staying here, buying house, cars and living a decent life here in US.

Getting a GC is part of my employment process for staying here for a longer duration without any visa hassles, this should not stop atleast any Indian to live life to the fullest here in US.

If you aren't going to be in US, even if you have an agent, there's is a risk that they might call you up for an interview you may not be able to go to.
If you are hard-up on info and don't want to go thro' headache, try one of the reputed ones.. stay away from WWICS..
For couple of thousand.. if you can get little help and good advise, it's not bad.. but most of these shops are akin to Desi consultants in USA. Lie, Cheat and make money .. that's the mission statement..
Apart from that.. process and forms are on the web. Tricky part is getting a job and living in Canada .. It's a honduras with worse looking people..

"Now with this huge deluge of immigrants, especially from the desi consulting companies, I feel that my quality of life is getting adversely impacted. Do not rush to conclusions that I am anti Indian or anti immigrant. 12 years back when I first got my H1 visa, the requirements to qualify were strict. "

i am not interested in giving red or blue dots but i do hope your citizenship application gets stuck in a processing delay, you too will then realize the implication of your so called Darwinian flush  As they say...when it happens to others its a recession, when it happens to you it turns into a depression...good luck..

I hope your post did not imply that the ones who got GC's were the 'brightest and the best'.

citizenship application is actually speeded up when democratic party is in power

In the past 4+ years, the annual H1 queue is just 65K. So the input into the EB queue must have moderated quite a bit.

Another piece of information, supporting your argument. This is posted on immigration-law.com today:

The DOL has yet to release its 3rd Quarter Performance report ending at the end of June 2008, but the second quarter report indicates that the foreign labor certification applications continuously dropped from the same period in FY 2007 including permanent as well as temporary labor certification applications. PERM applications dropped 46% from the statistics of the second quarter of FY 2007. The report indicates that despite increased audits (over 45%) and related work, the processing times remain steady. Obviously, it must have been affected more by decreased number of new applications than any drastic improvement in processing times in each application. In fact, from the perspectives of each PERM application, the processing times have witnessed a substantial delay over the last one year. The delay which was associated with the massive audit and related activities could have been offset by the substantial drop in the PERM applications in the overall statistical figure in the report. The DOL report did not report the details of the causes for continuing decrease in PERM applications, but this should be taken as an alert to the U.S. businesses as an indication of reduced incentives for the needed foreign workers to remain in the U.S. and potential reduced availability of the talented foreign workers to support the U.S. businesses' competition in the world. Considering the fact that the supply and demand of resources at the international level are not something which can be rebalanced over a night or a short period of time, the political leaders should start paying attention to the urgency of the reform in the employment-based immigration system before it gets too late.

    Thanks cableman.
If anyone has consulted any lawyer or applied for CA PR once it has expired, your inputs would be greatly appreciated.

Be honest, I don't know the real answers. You should find a lawyer to discuss this. I just share my thoughts. For your first question. I guess you should have no problem to enter Canada as long as your Maple card is still valid. However, I think when you renew your Maple card, you will have problem. For your second question. I think you can't re-apply PR as long as you still have the PR status. I think you may have to wait until your Maple card expires. I don't know the successful rate of re-applying PR. Enough point is one consideration, your intent to stay will be another consideration. I will be surprised if the immigration officer won't question you why you gave up the last PR status. You must prepare a good answer. Let me put in this way. Consider yourself is the immigration officer, will you question the applicant who gave up the status and re-applied again? Last advice. If you want to keep the PR, you should find a good lawyer to discuss the possibility of explaining to Canadian immigration why you need more time to move to Canada.

    as always.

i'm indian fyi. i'm not techie, i have nothing top do with body shops. and yes i'm a little offended by the streotypical crap.
i do not claim any "best and brightest status" either.
    here are my questions:

to the fighting indians: what good is the removal of a country cap on it's own? sure date for india will move a bit and row a little back. but most people will still be stuck because of the annual quota. without increased GC numbers the point of country quotas is moot.

to row warriors: i guess if it benefits you it must be fair. cool. maybe i would have felt the same in your place. but tell me...i came here and did a lot of education. today in EB2 people like me (and even less qualified than me) are walking through with today's PD. i am 10 years away from a GC. any good reason? why am is so bad? so inferior? why am i penalized for my place of birth? fair? whatever...
what if the same diversity were applied by occupation? religeon? color of skin? it's still diversity...would that be ok? if not then why place of birth? i'm not asking you to give up what you have by good fortune. just seeking acknowledgement that maybe there is something not quite fair here...

anyway as for this funny accusation on all indian students being H4's, wow you can say anything you want, right?
actually india and china are in teh top 5 receipents of F1 visas, and far ahead of most countries

IMV members and readers, we have been here in US for quite long and know the secret to successful life in US, just to say one: always abide by law and live your values.

After you get your GC, you may or may not visit IMV, fine. But make sure you look at things from an unbiased attitude and uphold your values and culture all the time. Most of you might retire in your home countries, so it makes every sense for us to look at how things are back home.

    My responses are in blue

My advice to you, this forum gives members a chance to voice their problems and many members help with suggestions and experiences. IV works for relieving our problems - and if their intentions are on our side, we need to help them and not fight amongst us or them. Judge by what the administrators of this org say.
    My Friend VedicMan
So let me get this straight. IV Senior members can abuse and threaten and basically talk bad about the post but i am NOT even supposed to respond to them with good words (please read all my replies)

And from your other statement, You have already decided that i am not only responsible for my post (And Yes i stand proudly by my post) but i am now also responsible for you guys abusing the post. I am goaing you !!!!! (You know for a second i did get a mental picture of me staning besides you with a stick and poking you in your stomach RESPOND TO THIS POST / RESPOND TO THIS POST / RESPOND TO THIS POST )

So the fact is my friend as i said before when some one has no more reparte to a give they end up making such posts. And as to you traditional upbringing which does not allow you to think that a gal can be confrontational as i said before you have the right to think whatever you want (Whether i am a guy or a gal or if you would like something else) that is your right and yes that thinking can also cloud your judjement (as it is doing now) but what you do NOT have a right is to decide that you are the Judge/Jury/Executioner of every thread opened on this forum

I cannot think of anyone with good intentions spending time to respond to comments that are not worthwhile.......
So senior members can abuse as much as they want and me instead of abusing back (Which you would really like me to do i know) am replying back in a calm measured response and that is once again my fault

You know with your twisted logic of justice and fair play if i am ever in court i would certainly NOT want you to be in the Jury. Infact i would not want you anywhere near the court because you might not even wait for the judgement. You would want to just go decide that i am at fault and get it done with

PS: and yes i am responding back because every response no matter how abusive or unfair like yours deserves an answer

Now is the time to donate money, a little bit of your time, a little effort to contact your lawmakers....

    You better start donating NOW

The following meanings are from Meriam-Webster online dictionary (http://www.m-w.com/dictionary/).

Meaning of donate (http://www.m-w.com/dictionary/donate): to make a gift of; especially : to contribute to a public or charitable cause.

Meaning of contribute (http://www.m-w.com/dictionary/contribute): to give or supply in common with others <contribute money to a cause>
    a : to give a part to a common fund or store <contribute to a fund-raising campaign>

b : to play a significant part in bringing about an end or result <many players have contributed to the team's success>

By giving money to IV you are contributing (= helpting yourself) NOT donating (= helpfing someone else).

    Friends,

Lets try to stay calm and be together during these tougher times. Some might be in a better position than others which does not mean they will not be in similar state later on.

There are knives hanging over our heads. Let us not forget that.

Let peace and common sense prevail. Please note that antis might be watching the dogfight within IV.

More than the money, these guys are plain stalkers! They don't leave you even if you are not interested and even after blindly telling them right on their face. Anywhere you go, Costco, Walmrt, Indian grocery stores, Malls these guys are right behind you. Next time i am calling COPS and i am going to report these guys.

Enough of leaving it or taking it lightly becasue of so called "your countrymen" stuff.

    what a PITA!

Because of all these experiences, even when you genuinely smile or strike a conversation with a desi, he/she first suspects you to be an ammway guy. I face it everyday, being "outgoing extrovert" in nature, I tend to smile and talk to people in elevators, walkways, malls, restrooms, groceries etc... which is mostly casual fun stuff and most times desis suspect that I am a ammway guy and cut me out harshly.
