I was wondering if anyone has any info on the job
market for international students in NY. I will be graduating
in Dec and will be on the job market soon.
Some of my friends say that there are jobs to be had but
not many are keen on sponsoring H1, even non-tarp firms.
Can anyone confirm/refute this?

Hello All,
I am currently in H1-B. My GC (EB2) is in progress sponsored by my company.
The I-40 is approved but me and my wife�s I-485 is still pending.
We both got our EADs, but we have never-ever used it. We just applied for it and kept the card.
My wife was also on H1-B through her own employment. She got laid off so she is losing her H1-B. Now I want to apply for her H4 as my dependant. Since she already has an EAD, will applying for H4 nullify the EAD? As I said earlier that she has never used her EAD however she plans to use it when she gets a new job.
Anybody in similar situation? Any remarks or suggestion would be greatly appreciated.

Good morning! Please clarify for my case details given below :
Labor approved, I140 denied for ability to pay. Employer had filed MTR with current tax returns documents. The labor has been filed & approved less than 180 days and I140 pending with MTR. H1B expires in 15th May 2011 completing all six years and no recapture periods left.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?

forgot to attach my previous employer experience letter
Same happened to me, I waited for RFE and send the experience letters when received RFE, but this can potentially increase your processing time.
Once you receive the receipt number, you could send the copy of experience letters if you are concerned about the processing time, (but that doesn't guarantee that you may not be issued RFE)

Usually change-of-status applications are considered abaondoned if one leaves the country but not extension-of-status. I do not see any problems with their travel here. Gurus?

Got an RFE to produce employment verification letter from my current employer. Yes, i changed the employer recently but didn't file AC-21.
Do you know how long USCIS takes to update the status online?

I am assuming that your lawyer sent it by some means that can verify that it was delivered.
USCIS usually takes about 7-10 days to update it online. (for example, if your RFE response was delivered to USCIS on Aug 10, expect it to be updated around Aug 17-20).
If you do not see update after 15 days of the delivery of the RFE response, call USCIS customer service so they can track it for you.

If you file the extension before expiry of the current I-94, you will be OK. It can be approved even after the expiry. She will be considered to be legally present without gap, if extension is granted.

How are you doing ? i am new to here. i will fill all details soon. sorry for that.
Before i stayed in place "X " which comes under nebrasaka centre, applied for 485, ead and ap. my company also in " X " only.
Right now i am in place " Y " which comes under Texas centre ( because of my job i moved recently) . Now i want to renew my ead and ap my self . my job, payroll and living is in place " Y " only.
But my pemanent address is " X " only. I want to continue that for my full GC process.
what my question is what i have to mention the address for my ead and ap renewal ?
1) is it "X " address as it is my permanent address and applied my 485 also from there and wish to continue or my "Y " address as i am working , living and payroll are here ?
2) If i mention " X " address is there any problem ? , dont think wrongly as i really dont know
3) if i put " Y " address is my case ead and ap along with 485 will move to Texas centre ?

Also you are not current yet...you will be (if things don't change in between) on Sept 1.
I don't know what final stage mean...I have been told the same thing by my congressman rep a year and half back.....doesn't mean anything...

EB3/EB2 categorization depends on a lot of other factors. But I understand your question is about base eligibility.
In general Masters requirement for a job is considered to be eligible for EB2.
Similarly Bachelors+5years exp req for a job is also considered to be eligible for EB2.
So your employers advertised job "could" very well be EB2 if all other conditions are met.

I came to know that with expired visa stamp we can not travel via UK and France. Can you please advice if I can travel via Frankfurt, Germany? or do I need to get a Transit Visa.

You need to file a COS from H-4 to H-1B. You cannot work until the H-1B is approved, because you are not in H-1B status now and therefore cannot use H-1B portability rules. You will not be subject to the cap since you have held H-1B status withing the past 6 years, and presumably not used a full 6 years.
Whether your last employer or a new employer files for a new H-1B status for you, it is still a new filing and any prior filings are not relevant, except to show that you are not subject to the cap.
By the way - this might get more comments if posted in the Nonimmigrant Visa section of the forum.

My PD is 08/04/06, and my AP is expiring on June 2nd, I probably will have to travel sometimes June end. I am in a fix if I should go ahead and apply for Ap now. My PD will be current begining June 1st. I heard it may take 1 week to 60 days to get GC after your date becomes current, Do you guys think it's good idea to just apply for AP just in case?
