    What rights did the Natives have in the 18th and 19th centuries when Europeans invaded their lands, and massacred most of them? Did they respectfully ask the Natives if they could immigrate? No? They walked in as if they owned this land. As a Canadian, I'm ashamed to say that this happened in my country too.

    That's an old story. The answer is: "if someone commits a crime, it doesn't give you right to commit crime".

    Why not go back and say "Well, Homo Sapiens themselves 150,000 years ago migrated to Europe from Africa and exterminated native Neanderthals. So why don't we just go and exterminate Europeans today and take Europe?"

    If it wouldn't be Europeans, there wouldn't be technological advanced United States and we wouldn't want immigrate here. We are not migrating to Kongo or Sierra Leone, don't we?

    Your statement completely misleads and not true.

    SL Tamils are not immigrants but are the native sons of northern part of the present geographical area known as Sri Lanka. Before Europeans came more than 500 years ago to Sri Lanka, SL Tamils had their own kingdom but when finally British left, they left the Tamils land and fate with the hands of the narrow minded majority, who started to discriminate ingenious Tamils left and right.

    Of course as you said, there are Indian Tamils in Sri Lanka who were taken by British to work in the tea plantations. Besides, Muslims in Sri Lanka also speak Tamil but they don�t usually associate racially with Tamils and maintain separate identity

    Current issue in Sri Lanka is between native Tamils and Sinhalese. Indian Tamils factor very minimal in this conflict.

    Please do some research before putting things in historical puerspective.

    You contradict yourself while saying "Your statement completely misleads and not true". I am saying this because you preferred not to comment on "Sinhala" part of my statement. So, should I safely assume that you are in agreement with that part? I agree with you on one thing as in my statement I did not enlist all probable historic migrations of tamils in past for an example during Chola invasion or at the time of Prince Vijaya.. But still I would say there is a truth in my statement as tamils were never been in such a huge proportion of sri lankan population in history. Today's almost 18-20% of tamil population in Sri lanka is due to the large scale migration happened during British time period. And yes if stick to the truthful definition of "native" neither Sinhala nor tamils are the natives of Sri Lanka as both ethenic groups have been migrated from India to Sri Lanka at some point of time in history. And we can not change the definition of "native" in every century. Can we?:)

    Just before any jumps on me :

    I respect , like and love the United States. It has taught me a lot, given me a lot of respect and made me a much better person.
    India is my country and I will get back there on some day. But I believe in a world without boundaries, and believe that political boundaries should not determine where/what I should do. That decision should be just made based on what/where I can be most productive/useful for myself and the society I live in. Hence I believe that USA/CA/India all are great nations/societies and we should respect them along with any other countries too.

    The reason we have greater supply of workforce in IT from one specific country is not because of skills or talents. Almost every IT workers from ROW and China came to the US as a foreign student after TOEFL, GMAT, GRE, internship and only then landed a job in IT. Whereas the preponderence of IT workers from India came here through L1/B1/H1 sponsorship through bodyshops. Attending school, preparing for generalized tests requires time, money and patience. This is one big factor why the supply curve is skewed.


    I am an Indian and also came as a student giving GRE/TOEFL. So do not generalize that IT workers from India came here via L1/B1 route. Some of them did but some did not. I know lot of Indian who came here to study.

    If India is producing more people qualified in these skills then its not their fault.

    The logic is that you are 'putting down roots' by buying a house. If all it takes is proof of closing a mortgage, one could always turn around and sell the house. somethng like that would undermine the credibility of IV in the medium/long run.

    I had initially advocated treating first time home buying as the same as marriage to an American citizen. In my opinion, that is a short,sweet,simple and sensible approach to follow that will also resonate/stick in lawmakers minds (rather than a long,rambling letter, no offense meant to the writers, it was quite well put together).

    Is unclear to me what the law is for those 2 cases

    1) You are with the employer that sponsored I140 and you get GC.

    2) You use AC21 and move to employer B and get you GC while at employer B.

    In both cases more than 6 months have lapsed since the I485 filling

    And the question is...:

    Are you free, after getting the GC, to move to another company or you need to stay with current employer for a certain amount of time?
    How would USCIS know if you moved?

    That means---> Once the labor is approved you have to use it in 45 days.
    ie apply for 140 in 45 days or LC is expired...I'm glad they did not propose to file I485 in 45 days :D

    I think 45 days is too short. Since LC cannot replaced, it cannot be used for anyone else. So I dont understand why they need an expiry date too...At lease a LC should be valid for 6 months.

    But we have to wait and see what the final rule is. There may be some changes fromt he proposed rule.

    Is the new Obama Administration going to consider "Instant GC" if we buy a House ? I'm thinking about the huge inventory of vacant house and how many could be bought up by GC holders... Its probably a fraction - Isn't it ?

    Thanks jungalee, for writing on this issue, that makes two of us. I think everything done by over 1000/2000 people together and every subject covered in letters from over 1000/2000 people makes it to the top. Most half educated (which is worst than illiterate) usually give priority to their petty differences and find reasons not to participate, which is why they remain "wise fools".

    It will definately help to draw attention to our issues if more people in the community will participate.

    I wish India allows absentee ballot.

    The way things are right now, as NRIs, we can't even register ourselves in the electoral rolls even if we want to plan a trip to India to conincide with election time.

    You can register to vote as long as you have a permanent address in India, which is pretty much anyone except a US citizen. Voting itself is inconvenient as you have to travel to your constituency for that.

    Can they use same LC for more than one I-140?
    Trying to understand damage done by LC substitution scams.
    My understanding is they can and they do that. U will only know when the AOS is taken up for processing. In this case there were 5 of them on the same labor. Even 140 gets approved, but not 485. I really wud like to know how VISA numbers get handled in these cases.
    I know several guys who took this path. Of them only one was a genuine case. All others were some kind of deals. Only one of them had a bad deal(Thanks to Mandalapa). Others r still happy with their EAD's.
    I mean this is a widespread practice. I situations like now when we have so few VISA numbers it is unfortunate one for us if those VISA numbers r lost.

    Quarterly spill over is the only sensible option which can be done at this time. This is the only option which might be doable and which is supported by both EB2 and EB3.

    Visa recapture and all the other major law changes - not much of a chance in this political climate.
    Re-instating vertical spill over - welcomed by EB3; but strongly opposed by EB2.
    Current spill over (horizontal) - welcomed by EB2; but strongly opposed by EB3.

    Quarterly spill over: no law change required; supported by both EB2 and EB3. This is the way to go.

    Unless IV request DOS for a quarterly spillover DOS would not do it. All the good things that happenned in the last 2 years were because of IV involvement starting with the July Fiasco when USCIS accepted 485 applications, I am sure the report published by USCIS about the pending 485 was done because of the FOIA filed by IV.

    Dear friends,
    I have a few questions regarding EAD renewal (based on pending AOS):
    1. When we apply for EAD renewal, do we have to go for fingerprinting again? I have heard conflicting reports about this - one lawyer said that we have to go for fingerprinting even if we have already done our biometrics once. However some of my friends have applied for EAD renewal and they didn't have to go for fingerprinting. I read some where that they won't call us for fingerprinting if we apply via paper instead or electronically. Is that true?

    2. Do we have to be in the US in order to apply for EAD renewal?

    Per this rule, Indians are eligible for SS benefits while living in India (at the time of claim), if they have lived in US for 10 years or have 40 Social security credits (That is 10 years of SS contribution.).

    Try to see if you can get prevailing wage determination for eb2 positions across the country.
