I pity people who have coming to USA is foremost objective. In my case, i came to USA 7 years ago. Atleast i earned few bucks. But people who are dreaming about USA and taking education loans with the intention to payoff once they land in USA. It also includes people coming here on F1 with intention to work here. I feel really sorry!!!

Yes very correct. I still don't get the reason for people's obsession of doing MS/MBA in US.
It makes no sense any more. 10-15 years ago it made sense. I have have been telling people to look outside US for MBA (practiced it myself for my MBA though I did my MS in US)

In short, you cannot challenge the law itself but, can challenge how the law is interpreted.

In general terms, yes that is the case and it should be. But what if some law is in direct conflict with the main theme or part of the constitution ?

Like here EEO bans consideration of country of origin but EB based immigration allows per country limit. Both concepts/practice are really attached with "Employment".

And all laws are really covered under the power of constitution? If not than where this one (per country based) lies? Constitutional OR non constitutional?

    Lessons YSR taught Sonia (http://blogs.timesofindia.indiatimes.com/masala-noodles/entry/lessons-ysr-taught-sonia)

Snippets.. go through all the user comments on the post in TOI.

YSR moulded democracy in AP in his own feudal mode. Hailing from the drylands of Rayalseema, where barren agriculture and lack of industry made an industry out of violence and extortion

YSR devised his own framework of governance that he started implementinng the moment he came to office in 2004. Simplistically stated this framework was an adaptation of the old zamindari system: under this YSR parcelled demarcated areas of the state to his loyal followers (who were elected as MLAs and MPs from these areas). Within the jurisidisction of these areas, these loyal followers were the kings - they were free to do anything (within limits) using the state's administrative machinery. In return, YSR wanted their loyalty and resources for the party kitty

Well, YSR delivered the state to her not once but twice and also financed a large part of the Congress campaign costs. In this comfort, Sonia forgot that the loyal Congressman had converted the party into his own personal satrapy

You can actually do it on your own. Dont mistake canadian GC process with the american green card process, Canadian process is well defined and simple.

I applied on my own. You can use this website, it is the candian government website. http://www.cic.gc.ca/english/index.html

    Application for 1 person:

    1. Lawyers fees = $500...............paid by me....not sure if any paid by my company
    2. AP+EAD = $350(170+180).....paid by me
    3. I-485 = $395..........paid by company
    6. Fedex = $60...........paid by me
    7. Medical = $170(no shots needed except TB test)....paid by me

So all i all I paid $1080 and my company paid atleast $395(and maybe some legal fees too)

And belive me guys I am at the lower threshold since I did not need any shots and did not loose any work days........

So minimum loss to the company and individual(1 pesron only)is atleast 1475 bucks. So before making any conclusions keep this as the lowest threshold. However since we might get the $395+$350 back so the net loss to the individual at minimum will be $730/person and maybe $500/person to the company so making it atleast $1230/for 1 person.

Assuming that appx. 45000 people were planning to apply....I guess we are at minimum $55350000 loss......and this is a very modest estimate......as I mentioned at the lower threshold.

I dont understand the whole point of discussion here ... What does the IV Senior Members think about this , The idea of a lawsuit to capture the loss immigrant visas, is not against USCIS, its against the system. Infact the USCIS should be on our side, as per the USCIS Ombudsman, Mr .

Atleast we should try , discussing and cribbing on the forum wont help.

Have you checked the latest news about USCIS Ombudsman's Mr. ? Here I am not talking on the behalf of senior members, if some leaders come forward, make efforts to sue USCIS, I don't doubt about the moral support from entire IV community including senior members.

Once it is law suit, USCIS is the system since it is what created this wastage of visa numbers.

Still, just because DOS told USCIS "Visas are exhausted" doesnt mean they should stop ACCEPTING new petitions. They can stop APPROVING new ones, but why stop ACCEPTING new petitions. Visa bulletins guide the filing as well as approval of petitions. If visa bulletins is current, then they can both accept and approve petitions.

Logiclife No offense but I would keep pushing your lawyer. If he was REALLY confident, he would have stuck to his guns and filed at the end of July, the very fact that he has said he will file in the Beginning of July means that he knows, s**t happens FAST when USCIS is concerned ;)

I remember reading last year a kid who posted something about why he doesn't like Saino was nabbed by cyber crime team near Delhi.Don't know what happened to him after that.

Also I read about Chetan Kunte in the NDTV-Mumbai issue.

CEC Gopalaswami said that Navin Chawla one of the EC always runs to loo breaks when they are in the middle of important decision making which may have not so good effect on a certain party and by the time Navin Chawla came back from loo break there would be a call from Congress party trying to pressurize the decision of Election commission.

I read somewhere Rahul Gandhi during Boston arrest was rescued by Saino men in Vajpayee govt.

Navin Chawla will most probably succeed Gopala Swami when he retires this month.

Of course we all know about our honorable president (with due respect to her ,her body language looks like I'm sorry madam I'm sitting on a sofa in front of you when I should be by your feet ,when she's around Sonia Gandhi)

Looks like this family has bought men all over the place. Now makes sense where all the scam money (be it oil scam or missile scam) goes.

No wonder Varun Gandhi's issue was made such a big controversy even when nothing was proved.

Kapil Sibal wanted to pull a Varun Gandhi stunt with Modi and Modi's response is hilarious.
"To Union Minister Kapil Sibal’s remarks that Mr. Modi should be arrested for his rabid remarks, he said: “You have my address and you are free to arrest me anytime, if you have the guts.” “The jail that could keep me in is yet to be built in India,” he said.

I've also been approached by Amway people both in the Bay Area and beyond. I despise their tactics and their deception as much as (or more than!) anyone.

But let's not let it affect our community. Let's not let a few bad apples ruin that unmistakable bond we feel in America when we spot a fellow desi from afar. Now, any time I approach a desi to make a friend, I state in a jovial-yet-serious way, "don't worry, I'm not one of those Amway guys!" That's obviously not the first thing I say, but I make sure to throw that line in during the first minute or so of the conversation. If the fellow desi knows Amway, it gets a laugh, "oh, phew, that's a relief!" Once at an IKEA, I saw a desi who seemed to be following me. Turned out he wasn't following me at all. I asked him in a clearly joking tone, "Please tell me you're not with Amway!" He burst out laughing and we became friends (needless to say, he was not with Amway!).

So why don't we all agree on a similar approach? If we meet each other in public, let's simply state that we're not with Amway. And if you're accosted, simply ask that person if they're affiliated with Amway. Plain and simple.

How does this sound to others?

Sounds like a good approach. I am going to use this line as a greeter in the future.

"Tomorrow if we or our generations are getting killed in the US, would you say the same thing" ....

Of course yes! If our generations are US citizens, US govt should take care of them and if they are part of any terrorist organisation, they should be treated the way terrorists are treated.

"Country needs to care about its people" ... Its is in your quote ... Issue is about Srilankan's and their goverment should take care of it, NOT India. I don't think any one has a doubt about how LTTE should be handled.

Agreed but some Govt. fails to do so. IF Govt. were acting resposibly , World wouldn't have seen the WW1 and WW2 and Bosnia-Serbia crisis and countless other masscare !

One should understand difference b/w ' Srilankan Tamils' and 'LTTE'.

Long 19 page memo - but loud and clear for many scenarios -
    http://www.uscis.gov/USCIS/Laws/Memoranda/2010/H1B%20Employer-Employee%20Memo010810.pdf

    USCIS posts Q & A:
    http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=3d015869c9326210VgnVCM100000082ca60aRCR D&vgnextchannel=68439c7755cb9010VgnVCM10000045f3d6a1 RCRD

This memo is an eye opener especially for folks on consulting company assignments and those who are self-sponsored or who want to do their own business. Finding a new H1 sponsor would be extremely difficult as well (AC21 folks beware).

Now getting a new H1 or a transfer or a renewal, may be subject to very stringent scrutiny.

This memo has the potential to throw a lot of small boutique Consulting companies out of business and along with it many of their employees - whether they use H1 or not.

Wish the best for all affected folks.
Pray and hope the GC dream is realized faster for all.

    Best Wishes

You guys keep saying diversity is a FB immigration problem only not EB, hence no cap needed in EB.
REALLY? Is it a coincidence that a desi company owner will usually have 99% of his emploees Indian? Thinking that employment depends only on skills is not realistic. A lot of the networking based on national origin interferes with how at least H1 jobs are landed here. So there is a reason to have rules preventing a monopoly.

    Cheers.

Yes skills don't need a cap. If I am a business owner, I have all rights to hire best and brightest in the world. It is my choice whom I hire not Government tells me where to go for hiring. Business may hire from India or Antartica, it should not be anyone's damn concern. Let the free markets work !!! This is insane

My son recently finished his high school and wanted to do Dental degree in India. My current situation is I have applied for adjustment of status in July 2007. Me and my family got the EAD and AP. My priority date is Eb3-November 2005. WIth this mess, I am not sure when I will get my green card.
    My question is:
Can I send my son to India for his studies when the adjustment of status is pending. Will it be considered as abondaned if he is out of US when the adjustment of status is in progress?.
Is there any specific forms for this type of situation so that he can go for studies in India and continue the adjustment of status.

    Hello,

If your son has a AP then he can go study in India so long as he comes back every year and renews his AP. If he continues to do this his status will not be considered abandoned.

These rules has always been and so are they right now. Nothing is new in the memorandum. Some one publishes and one points and makes a comment and everyone else like a herd of sheep starts panicking...

Right these are nothing new. They have been followed up (very well I should add) by USCIS consistently for over 2 years now

If per Country Laws are removed in issuing Green Cards, then 90% of the employment based Visa's will be given to Indians and that too in the IT Sector.

Mostly the country will be Indians, chinese, mexicans . The Law makers don't want to colonize America.

There is a lot of stress that was done in making that decision

You can challenge this but i would say, you will never win it.

You can challenge the State but cannot win it.

    Yearly permitted H1s - 65000
All EB ased GC applicants: 500000 (Approx.)
As per you theory: 90% Visas will be given to Indians
    US Population: 300 million (Approx.)

Do the math and prove me how it will be colonized ? And define the word: "Colonized"... as you were also talking about chinese and mexicans..

yes, aim seemed to be control the Genetic Pool but your statement is way streched...
